§ 1 Scope and Provider

(1) These General Terms and Conditions apply to all orders placed by you with Rollgut®, owned by Thomas Sommer (hereinafter referred to as the "Seller" or "we").

(2) The range of goods in our online shop is directed exclusively at buyers who have reached the age of 18.

(3) We do not recognize any deviating terms and conditions of the customer unless we have expressly agreed to their validity in writing.

§ 2 Conclusion of Contract

(1) The presentation of goods in our online shop does not constitute a legally binding offer to conclude a contract, but rather a non-binding online catalog.

(2) By clicking the button "Order with obligation to pay," you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order is sent immediately after submission via an automated e-mail. This order confirmation does not yet constitute acceptance of the contract.

(3) We may accept your order by sending a separate order confirmation via e-mail or by delivering the goods within 2 days.

(4) The text of the contract is not stored by us after the contract is concluded and is no longer accessible to the customer. The language available for the conclusion of the contract is German.

§ 3 Prices and Terms of Payment

(1) All stated prices are total prices including statutory VAT, plus shipping costs.

(2) Shipping costs are clearly communicated to you during the ordering process.

(3) Payment may be made via advance payment, Klarna, SumUp, or credit card. The available payment methods are displayed in the online shop.

(4) If the customer defaults on payment, we are entitled to charge a flat-rate reminder fee of EUR 5.00 for each reminder issued after the default has occurred. The customer reserves the right to prove that we incurred no damage or significantly less damage.  Should it become necessary to initiate judicial dunning proceedings or to commission a debt collection agency, additional statutory costs and fees will be incurred and must be borne by the customer.

§ 4 Delivery and Shipping Terms

(1) Delivery is made to the delivery address specified by you.

(2) The delivery time is indicated in the respective item description in the webshop. As the products are handmade, the maximum delivery period stated directly on the product applies.

(3) If delivery of the goods fails due to your fault despite three delivery attempts, we may withdraw from the contract. Any payments made will be refunded to you without delay.

§ 5 Retention of Title

The goods remain our property until payment has been made in full.

§ 6 Warranty (Liability for Defects)

(1) Statutory warranty rights apply.

(2) Our products are handmade, unique items made from wood, a natural material. Minor variations in color, grain, and shape are characteristic of handmade wooden products and do not constitute a defect.
§ 7 Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. You can find the full instructions on the right of withdrawal and the model withdrawal form on a separate page in our webshop.

§ 8 Liability

(1) We are liable without limitation for damages resulting from injury to life, body, or health caused by an intentional or negligent breach of duty on our part.  (2) In the event of a breach of essential contractual obligations—obligations the fulfillment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)—we shall also be liable for simple negligence; however, such liability is limited to damages that are foreseeable and typical for the contract at the time of its conclusion.

(3) Otherwise, liability is excluded.

(4) Liability under the Product Liability Act remains unaffected.

§ 9 Dispute Resolution and Final Provisions

(1) German law applies, excluding the UN Sales Convention (CISG). In the case of consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.

(2) The European Commission provides a platform for online dispute resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

(3) Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
